This privacy statement concerns Ultimum MSP B.V. The address and corporate information for Ultimum can be found here Our privacy statement consists of two parts: Section 1: A first part relating exclusively to freelancers, employees of contractors, and potential temporary employees. Section 2: A second part relating exclusively to employees or representatives of (potential) clients, suppliers, and other companies.

Ultimum processes personal data for the execution of its mission: the acceptance and execution of ICT projects for, and the provision of ICT knowledge to, as well as the insourcing of applications and ICT services from, clients.

1. Data processed by Ultimum regarding freelancers and potential temporary employees

The starting point for the processing of your personal data is that you provide this data to Ultimum yourself/voluntarily, and only for the following purposes, namely:

a) to comply with applicable laws and regulations;
b) to assess your suitability for a specific position or assignment, to record your availability, and to put you in contact with one or more (potential) clients;
c) to enter into a relationship with you as a temporary employee, freelancer, self-employed professional (ZZP’er), or otherwise as a contractor (a "temporary worker") and to maintain accurate administration for this purpose, or to enter into a relationship aimed at recruiting for/executing assignments and to maintain (financial) administration for this purpose;
d) to conclude and execute agreements with our client(s);
e) to fulfill our reintegration obligations for temporary employees;
f) to inform you about our services, other activities, and/or professional information (for example, via email, newsletters, company magazines, and trade literature) and to be able to make offers to you on behalf of Ultimum;
g) to generate management information and perform market analyses, (internal and external) checks, audits, and financial audits;
h) if applicable, to have an external party verify the validity of the identity document provided by you and/or to have a screening performed.

You make your data available by sending us a CV and any other related data via email or another medium. For this reason, the following data may be processed:
Contact details (name, address, city of residence), email address, telephone number, nationality, date and place of birth, gender, marital status, work experience, bank account number, education and training details, (copies of) certificates, references, and where legally permitted, a (copy of a) passport photo, (copy of) ID document, BSN (Citizen Service Number), (copy of) work permit, and (copy of) residence permit.

What are Ultimum's legal bases for processing personal data?

For the aforementioned purposes a) through h), Ultimum requires reasons under the GDPR (legally these are referred to as "legal bases") to process your personal data. This is because the processing of personal data is:
a) necessary for Ultimum to comply with a legal obligation;
b) necessary for entering into an agreement between you and a client;
c) necessary for the performance of an agreement with you;
d) necessary for the performance of an agreement with our clients;
e) based on your consent to receive this information;
f) in the legitimate business interest of Ultimum;
g) insofar as screening is necessary for a position, required to be able to enter into an agreement.

Transfer of personal data to third parties

Ultimum may transfer your personal data to its (potential) clients, suppliers (for example, educational institutions), audit bodies, government agencies, subcontractors, and to companies and/or individuals it has engaged to perform specific tasks (including processors). Additionally, Ultimum may provide your data to third parties if it is entitled or obliged to do so based on applicable laws and/or regulations, a court order, or a judicial judgment, or if it has obtained your consent to do so. Furthermore, after you have given your consent, Ultimum may post your profile or CV, whether or not anonymized, within a private section on its website(s) and client portals.
Ultimum does not store your personal data longer than is necessary for the purposes for which this data was collected and adheres to the applicable laws and regulations in this regard.

2. Data processed by Ultimum regarding contact persons of (potential) clients, suppliers, and other companies

Personal data that Ultimum receives from employees or representatives of (potential) clients, suppliers, vendors, and other companies or institutions (the “contact persons”), we use for the following purposes:

a) to enable you to make use of our services and/or for us to make use of your services;
b) to enter into and maintain a commercial relationship with you;
c) to agree upon assignments and/or to be able to execute them (or have them executed);
d) to inform you about our services and other activities (for example, via email, newsletters, and company magazines) and to be able to make offers to you;
e) to be able to comply with applicable laws and regulations.

What are Ultimum's legal bases for processing personal data?

a) to enable you to make use of our services and/or for us to make use of your services;

Ultimum does not store your personal data longer than is necessary for the purposes for which this data was collected and adheres to the applicable laws and regulations in this regard.

Data storage and security

Personal data processed by Ultimum is stored and retained within the EU. In cases where Ultimum must store personal data outside the European Union, we ensure that the GDPR rules for international data transfer are complied with.

Ultimum makes every effort to take appropriate organisational and technical measures to secure your personal data against unlawful processing and/or loss. Ultimum employees who have access to personal data are bound by a confidentiality clause.

Processors

For our services, Ultimum must work with external parties that receive and process personal data on our behalf. Examples include providers of email solutions, cloud storage, and cybersecurity. Such external parties are called ‘processors’ under the GDPR. Ultimum has entered into contracts with all processors that comply with privacy legislation. Your rights under the GDPR

Under the GDPR, you have several rights that you can exercise regarding the personal data that Ultimum processes about you. This concerns the right of access, adjustment, rectification, or erasure of your data, the right to object to or restrict our processing, as well as the right to data portability of your data. Amending the privacy statement

Ultimum may amend this privacy statement. The most current version can always be consulted via the Ultimum website.

Liability

Ultimum's liability for indirect damages under this privacy statement, including consequential damages and loss of income, is excluded in all cases. Any potential liability is furthermore limited to a maximum amount of €1,000 per event and a maximum of €10,000 per calendar year for all events combined. Furthermore, Ultimum's liability will, in any case, never exceed the amount covered and paid out by its insurance in the relevant case.
